Terms of Service

By accessing or using Fanvault ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

You must be at least 18 years of age to use this Platform. By using Fanvault, you represent and warrant that:

• You are at least 18 years old;
• You are legally permitted to access adult content in your jurisdiction;
• You have not been convicted of, or pled guilty to, any sexual offense involving a minor;
• All information you provide is accurate and complete.

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information;
• Maintain the security of your password;
• Notify us immediately of any unauthorized use of your account;
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

Creators who wish to upload content and earn revenue must complete identity verification (KYC) before their content becomes publicly available. This includes:

• Submitting a valid government-issued photo ID;
• Submitting a selfie holding the ID;
• Confirming they are 18 years of age or older.

Fanvault maintains records of all identity verification documents in compliance with applicable laws, including 18 U.S.C. § 2257 where applicable.

5.1 Permitted Content

Fanvault permits adult content created by and featuring verified adults (18+). Creators may also sell physical items through the integrated shop feature, including but not limited to signed merchandise, handmade items, apparel, and personal items.

5.2 Prohibited Content

The following content is strictly prohibited and will result in immediate account termination and reporting to law enforcement:

• Any content depicting individuals under 18 years of age in a sexual context;
• Non-consensual content or content depicting sexual violence;
• Content that promotes or glorifies violence, hate speech, or discrimination;
• Content that violates any applicable law or regulation;
• Impersonation of any person or entity;
• Content that infringes on third-party intellectual property rights;
• Spam, malware, or any harmful code.

5.3 Physical Shop Items

Creators may sell physical items through the Fanvault shop. All items must be accurately described. Fanvault does not inspect physical items but reserves the right to remove listings that violate these Terms or applicable law. Sellers are solely responsible for ensuring their items comply with all applicable laws in both the seller's and buyer's jurisdictions.

Creators retain 80% of all gross revenue generated through subscriptions, pay-per-view content, tips, and shop sales. Fanvault retains 20% as a platform fee.

Payouts are processed on the 25th of each month for the preceding month's earnings. The minimum payout threshold is $20.00 USD. Earnings below this threshold are carried over to the next payout period.

Available payout methods include bank wire transfer and Paxum. Transfer fees associated with payouts are deducted from the creator's earnings. Fanvault is not responsible for delays caused by third-party payment processors.

Fanvault reserves the right to withhold payouts pending investigation of potential Terms violations.

Fanvault operates a points-based system for fan-to-creator interactions. 100 points equal $1.00 USD. Points are used exclusively for messaging and tipping creators. Points are non-refundable once purchased. Points have no cash value and cannot be transferred between accounts.

Fans may subscribe to creator profiles on a monthly basis. Subscriptions automatically renew unless cancelled before the renewal date. All payments are processed through our third-party payment processor. Fanvault does not store payment card information.

Refunds for subscriptions are not provided except where required by applicable law.

Creators retain full ownership of all content they upload to the Platform. By uploading content, creators grant Fanvault a non-exclusive, worldwide, royalty-free license to display, distribute, and promote the content on the Platform.

Fans may not download, reproduce, distribute, or share any content from the Platform without express written permission from the creator.

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference.

Fanvault respects intellectual property rights. If you believe your copyrighted content has been uploaded to the Platform without your permission, please contact us at legal@fanvault.com with the following information:

• Identification of the copyrighted work;
• Identification of the infringing material and its location on the Platform;
• Your contact information;
• A statement of good faith belief;
• A statement of accuracy under penalty of perjury.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FANVAULT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

FANVAULT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Fanvault is not responsible for the content uploaded by creators or the physical items sold through the shop.

You agree to indemnify, defend, and hold harmless Fanvault and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Cyprus.

All creators on Fanvault are required to verify their age before uploading any content. Fanvault maintains records as required by 18 U.S.C. § 2257 and its implementing regulations. Records are available for inspection at: legal@fanvault.com.
